How to Obtain a Building Permit in Bulgaria — A Practical Guide for Foreign Investors

If you are a foreign investor, a property owner based abroad, or a company looking to develop real estate in Bulgaria, one of the first questions you will face is: how do you actually obtain a building permit? This guide explains the process clearly — without the jargon — so you know what to expect before you start.

Who Can Apply for a Building Permit in Bulgaria?

A building permit can be applied for by the property owner, or by a person who has been granted the right to build on the property through a notarial deed or a construction right agreement. As a foreign investor or Bulgarian citizen living abroad, you can authorize a local representative through a notarized power of attorney to handle the entire process on your behalf.

What Authority Issues Building Permits in Bulgaria?

Building permits in Bulgaria are issued by the Chief Architect of the relevant municipality. For larger or more complex projects, the Regional Directorate for National Construction Control (RDNSK / РДНСК) may also be involved. The applicable authority depends on the category of the construction project under the Spatial Planning Act (ZUT).

What Do You Need Before Applying?

Before you can apply for a building permit, several preliminary steps must be completed. You need a valid Visa for Design (Виза за проектиране) issued by the municipality, which defines the permitted building parameters for your plot. You also need a completed and approved Investment Design (Инвестиционен проект) prepared by a licensed Bulgarian designer, covering all required parts — architectural, structural, electrical, plumbing, and others depending on the project type. Additionally, you need proof of property ownership, a cadastral sketch, and a certificate of regulatory status.

How Long Does It Take to Obtain a Building Permit in Bulgaria?

Once you submit a complete application with all required documents, the Chief Architect has 14 to 30 days to issue the permit by law. However, the total timeline from the start of the process — including design preparation and approval — is typically 3 to 9 months. In smaller municipalities such as Lovech, Troyan, or Vidin, the process often moves faster than in Sofia, where the workload is significantly higher.

Can You Manage This Process Remotely?

Yes — and this is where many foreign investors and Bulgarians abroad struggle most. The process involves multiple trips to the municipality, coordination with designers, surveyors, and notaries, and communication in Bulgarian with local authorities. With a properly authorized local representative, the entire process can be managed remotely. You do not need to be physically present in Bulgaria at any stage.

What Happens After the Building Permit Is Issued?

Once the building permit is issued, you need to officially open the construction site with a protocol signed by the builder, the designer, and a licensed construction supervisor. A licensed construction supervision firm must oversee the entire construction process. At the end of construction, the building goes through a commissioning procedure to receive its Certificate of Use (Act 16), which is the document that makes the building legally habitable and usable.
